Terms and Conditions

 

1. General Provisions

1.1 These Terms and Conditions (“Terms”) govern all sales and transactions between the customer (“Buyer”) and Pilot & Crew Store (“PCS”), established in The Netherlands.
1.2 By placing an order through our website, you agree to be bound by these Terms.
1.3 PCS reserves the right to amend these Terms at any time. The version applicable at the time of order placement shall apply.

2. Pricing and Product Information

2.1 PCS aims to provide accurate product information and competitive prices at all times. Prices and specifications may change without prior notice due to supplier adjustments, exchange rate fluctuations, or typographical errors.
2.2 PCS cannot be held liable for any printing, typographical, or technical errors in pricing or product descriptions.
2.3 All prices are listed in euros (€) and include VAT where applicable, in accordance with Dutch tax law.
2.4 For custom or non-standard products, PCS may require a non-refundable deposit before commencing production.

3. Acceptance of Orders

3.1 All orders are subject to acceptance by PCS. Automated order confirmations generated by our website do not constitute acceptance but merely acknowledge receipt.
3.2 PCS reserves the right to refuse or cancel orders for legitimate reasons, such as stock unavailability, pricing errors, or suspected fraudulent activity.
3.3 A binding contract is established only once PCS confirms the order in writing or issues an invoice.

4. Delivery, Risk and Ownership

4.1 Estimated delivery times are indicative only. PCS shall not be held responsible for any delay or cost arising from causes beyond its reasonable control, including but not limited to courier delays, customs procedures, strikes, or force majeure events.
4.2 Risk in the goods passes to the Buyer at the time of delivery.
4.3 Ownership remains with PCS until full payment of all outstanding amounts has been received.
4.4 PCS is not responsible for costs, losses, or damages incurred due to external factors beyond its control, such as courier errors, incorrect customer data, or third-party service disruptions.

5. Shipping and Returns

5.1 Shipping costs are applied in accordance with the rates displayed on the website during checkout.
5.2 International shipping fees and delivery times may vary depending on destination and carrier availability.
5.3 Items returned to PCS are at the Buyer’s risk and expense unless otherwise agreed in writing.
5.4 Returns from outside the European Union (EU) may be subject to import duties, customs handling fees, and VAT upon re-entry into The Netherlands. These charges are entirely at the Buyer’s expense and will not be reimbursed or deducted from any refund.
5.5 Products that fall under hygiene regulations (such as hosiery, socks, and underwear) cannot be returned once the packaging has been opened.
5.6 Returned items must be in their original, unused condition, complete with all packaging and tags. PCS reserves the right to reject returns that do not meet these conditions.

6. Right of Withdrawal (Consumers Only)

6.1 In accordance with EU Directive 2011/83/EU, consumers have the right to withdraw from their purchase within 14 calendar days of delivery, without stating a reason.
6.2 To exercise this right, the Buyer must notify PCS in writing (by email or via the online contact form) within the withdrawal period.
6.3 The Buyer must return the goods within 14 days after notifying PCS.
6.4 PCS will issue a refund within 10 days after receiving the returned goods in acceptable condition.
6.5 Original shipping costs and payment processing fees are non-refundable unless otherwise required by law. Return shipping costs are borne by the Buyer.

7. Tailor-Made and Customized Products

7.1 The right of withdrawal does not apply to tailor-made or personalized products. This includes, but is not limited to, embroidered uniforms, name tags, custom-sized garments, and uniform blazers with sleeve stripes or rank insignia. These products are considered customized goods as defined by the EU Consumer Rights Directive (2011/83/EU).

7.2 Cancellation requests for customized orders can only be accepted if production has not yet begun.

7.3 If production has already started, the Buyer remains liable for all costs incurred up to that point, including materials, labor, embroidery, tailoring, and customization work.

7.4 Once customization is complete, or the item has entered the final production stage, the order cannot be cancelled, altered, or refunded under any circumstance.

7.5 By placing an order for a tailor-made or customized product, the Buyer explicitly acknowledges and agrees to these terms.

8. Payment Terms

8.1 Payment is due in full at the time of ordering, unless otherwise agreed in writing.
8.2 PCS reserves the right to suspend or cancel orders if payment is delayed or rejected.
8.3 In case of late payment, PCS may charge statutory interest in accordance with Dutch law (Burgerlijk Wetboek 6:119).
8.4 Returned or rejected payments may incur administrative and banking fees, which will be charged to the Buyer.

9. Limitation of Liability

9.1 PCS shall not be liable for indirect, incidental, or consequential damages, including but not limited to loss of profit, delay costs, or damages caused by third parties.
9.2 PCS is not responsible for any costs, losses, or obligations resulting from circumstances beyond its control, including but not limited to:

Postal or courier delays;
Supplier or manufacturer errors;
Exchange rate changes;
Force majeure events such as natural disasters or political unrest.

9.3 In all cases, PCS’s total liability shall not exceed the total purchase price of the relevant order.

10. Governing Law and Dispute Resolution

10.1 These Terms are governed by the laws of The Netherlands.
10.2 Any dispute shall first be addressed amicably between PCS and the Buyer.
10.3 If no resolution can be reached, the dispute shall be submitted to the competent court in The Netherlands.

11. Privacy and Data Protection

11.1 PCS processes personal data in compliance with the General Data Protection Regulation (GDPR).
